Terms of Service

1. The Service

SecondBrainOS is a SaaS platform that lets businesses connect their own WhatsApp Business and Instagram Business accounts to a unified inbox where human agents and custom AI assistants respond to customer messages. The Service also provides knowledge management, workflow automation, and AI agent tooling accessible via the web app, API, and MCP integrations.

2. Accounts & eligibility

Accounts are provisioned upon purchase; there is no public self-signup. Authentication is passwordless via magic link. You are responsible for maintaining the confidentiality of your login, API keys, and any credentials you connect, and for all activity under your account. You must be at least 18 years old to use the Service.

3. Connected channels & Meta platforms

When you connect a WhatsApp Business or Instagram Business account, you authorize us to send and receive messages on your behalf through Meta’s APIs. You are responsible for ensuring your use of those channels complies with the applicable Meta Platform Terms, WhatsApp Business Policy, Instagram policies, and all applicable laws (including messaging-consent and anti-spam requirements). You own your connected accounts and the customer conversations conducted through them; we process that data only to provide the Service.

4. Acceptable use

You agree not to use the Service to:

• send unsolicited, unlawful, deceptive, or harassing messages;
• violate the rights of others or any applicable law or platform policy;
• attempt to gain unauthorized access to, disrupt, or reverse-engineer the Service or its infrastructure;
• upload malware, or content you do not have the right to process or share.

We may suspend or terminate access for violations of these Terms or applicable platform policies.

5. Your content

You retain ownership of the content, knowledge bases, workflows, and messages you provide or generate through the Service. You grant us a limited license to host, process, and transmit that content solely to operate and provide the Service to you. You are responsible for any third-party personal data you obtain or share through the Service and for having a lawful basis to do so.

6. Payments

Paid features are billed through Stripe. Fees, credits, and usage-based charges are described at the point of purchase. Except where required by law, payments are non-refundable. We do not store card or bank details.

7. AI outputs

AI-generated responses may be inaccurate or incomplete. You are responsible for reviewing outputs before relying on or sending them, particularly in customer communications. The Service is provided as a tool and does not constitute legal, financial, or professional advice.

8. Availability & changes

We aim to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features, and may update these Terms; material changes will be communicated and the revision date above updated. Continued use after changes constitutes acceptance.

9. Disclaimers & limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. To the fullest extent permitted by law, SecondBrainOS shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits arising from your use of the Service. Our aggregate liability shall not exceed the amounts you paid us in the twelve months preceding the claim.

10. Termination

You may stop using the Service and request deletion of your account at any time via the in-app deletion flow or by contacting us — see our Data Deletion page. We may suspend or terminate accounts that violate these Terms. Provisions that by their nature should survive termination will survive.

11. Governing law & contact
